Franchise Attorneys Field a Lot of Questions. Not This One.

This: What is your favorite part of being a Franchise Attorney?

But before I share their answers, you need to know that Franchise Attorneys are among the most specialized legal professionals in practice today. They don’t dabble. They go deep into one narrow discipline — and they have to know it cold.

Consider what that means. They must understand the FTC’s Franchise Rule inside and out. As a matter of fact, they live in the Franchise Disclosure Document, all 23 items of it.

Plus, they know which states require registration, which offer exemptions, and what the difference means for their clients. Including their franchisor clients.

In addition, franchise lawyers handle franchise agreements, area development deals, and multi-unit structures. They navigate territory rights, transfer clauses, and renewal terms. They know when an Item 19 earnings claim looks off.

Finally, they understand when a dispute calls for negotiation — and when it calls for litigation.

What is Your Favorite Part of Being a Franchise Lawyer?

I asked franchise attorneys who are Featured on The Franchise Attorney Directory that question. Here are their answers.

I enjoy helping people navigate the starting and growth of a business. Franchising presents a great opportunity to do so but there are many landmines to be avoided along the way. I enjoy helping people navigate these strategic issues.”

Josh Brown

My favorite part of being a franchise attorney is helping entrepreneurs turn their vision into a scalable, successful business. Franchising is a unique blend of legal strategy and business growth, and I enjoy guiding clients through that process, from structuring their franchise system to protecting their brand and ensuring compliance. It’s especially rewarding to see clients expand into new markets, create opportunities for others, and build something that has a lasting impact.”

Daniel H. Weberman

Educating an eager young franchisee on how to respond to a franchisor when the franchisor states without hesitation ‘our agreement is non-negotiable and we must have uniformity among all our franchisees.’ I explain to the franchisee what issues many franchisors are, in fact, willing to consider and how to approach the franchisor strategically and tactfully (but firmly), and how the modifications to the ‘non-negotiable’ franchise agreement will be documented. Playing a critical behind-the-scenes role for the franchisee — adeptly navigating the client through the substantive and political issues at inception of the relationship, all without risking alienating a franchisor who doesn’t want to see a new franchisee ‘lawyering up’ from the outset — is important for any franchise attorney to understand, and having practiced in this area of law for many years it is a role that I have embraced and have found professional satisfaction.”

Scott Lewis

What I value most about being a franchise attorney is the opportunity to operate at the highest level within a complex and highly exclusive legal field. Franchise law requires not only persistence and legal excellence, but also strategic vision and sharp business and financial acumen.

Robert Zarco

My favorite part is the problem-solving. Every client situation is different, whether it’s navigating FDD compliance, structuring a deal, or engineering a clean exit from a franchise relationship. There’s no cookie-cutter answer in this work. I get to dig into the details, understand what’s truly at stake for the client, and find the best path forward. That combination of legal strategy and real business impact keeps it genuinely interesting, deal after deal.”

My favorite part of being a franchise attorney is the fact that I can provide specialized, practical advice to people starting a new business. My clients appreciate the fact that I understand the franchise field and are eager to be guided. A successful franchisee is one who understands the terms of their franchise agreement and commercial lease and is not surprised when those terms come into play because they have already carefully studied those documents with their attorney.”

Yvonne Holden

I love being a franchise attorney because every deal is a moment of decision. Someone is stepping out and betting on themselves. Many are doing it for the first time. My job is to cut through the sales pitch, see what matters, and call out the risks before they become problems. It is not just about the documents. It is about protecting what they are building and giving them the confidence to move forward when it counts.”

Rush Nigut

My favorite part about being a franchisee lawyer is helping franchisees see reality — unfortunately the reality of franchising is very different than what they had been promised by their franchisors. Only when armed with the true reality can franchisees make optimal decisions for themselves, their families and their customers.

Jeffrey M. Goldstein

My favorite part is serving as trusted counsel at a pivotal moment. For franchisees, that means cutting through the excitement of a new opportunity to ensure they truly understand what’s in the agreement — and what may never have come up in conversations with the franchisor. For franchisors, it’s helping business owners who’ve built something great discover whether franchising is the right path to grow it. Either way, I enjoy helping people navigate through one of the most significant financial decisions of their careers.”

Brian J. Ritchey

My favorite part of being a franchise attorney is helping business owners succeed. In some circumstances, that’s helping them get into the right franchise and grow within that franchise through strong protective leases and asset purchase agreements. For other franchisees, that’s helping them escape from a franchise system that is failing or getting them compensation when a franchise sale was induced by fraud.”
