Franchise Laws in Arizona: The Basics You Should Know

Arizona is a welcoming place for franchises, and the rules here are fairly straightforward. But, you still need to find Arizona Franchise Attorneys to hire.

Unlike some states with strict filing requirements, Arizona franchise laws do not make franchisors register or send disclosure documents to the state before selling a franchise. That means the process can move faster, but it also means buyers need to do their homework.

Even though Arizona doesn’t add extra hurdles, every franchisor must still follow the Federal Trade Commission’s (FTC) Franchise Rule. This rule requires that you receive a Franchise Disclosure Document (FDD) at least 14 days before you sign an agreement or pay any fees. The FDD includes critical details like startup costs, ongoing payments, assorted fees and the company’s history. Litigation too.

That said, franchise agreements in Arizona are treated just like contracts, so the words on the page really matter. While the state recognizes a duty of good faith and fair dealing, there aren’t special “franchise relationship” laws to protect issues like renewals or territory rights.

Finally, Arizona’s Consumer Fraud Act does offer protection if there’s deception or fraud, but the best defense for a franchisee is to carefully read, understand, and negotiate the contract.
